Need help with Allstate - Matching

Need help with Allstate!! Trying to get roof approved by matching/“reasonably uniform appearance”

The policy is RCV

TN Law is (b) with quotations. Allstate’s response is below that.

“(b) When a loss requires replacement of items and the replaced items do not match in quality, color or size, the insurer shall replace items so as to conform to a reasonably uniform appearance according to the applicable policy provisions. This applies to interior and exterior losses. The insured shall not bear any cost over the applicable deductible, if any.”

The policy excludes matching

Below are the applicable policy provisions.

SECTION I — PERILS INSURED AGAINST

A. Coverage A — Dwelling And Coverage B — Other Structures

  1. We insure against direct physical loss to property described in Coverages A and B.

  2. We do not insure, however, for loss:

a. Excluded under Section I — Exclusions;

c. Caused by:

(6) Any of the following

(k) Mismatch of color between undamaged material and new material used to

replace old, weathered or oxidized damaged material; or

(l) Mismatch between undamaged material and new material used to repair or

replace damaged material due to outdated, obsolete or discontinued

products.

Policy cannot contradict law unless the law has some caveats such as “unless specified specifically in the policy language, blah, blah.” Consult a PA or Attorney. It’s Allstate, tell the HO to call their Agent and the VP of Claims at Allstate and share their frustration. Tell HO to research their choice in Insurance Providers a bit more thoroughly.
